Rules for using the website www.biobuilds.com
Welcome to www.biobuilds.com. This document describes the rules for using the website and the relationship between BIOBUILDS S.R.L. and its visitors.
Access to and use of the website www.biobuilds.com are subject to these rules. The information on the website is informative and pre-contractual. The purchase of a BioBuilds module is made only on the basis of a personalised offer and an individual contract signed by both parties, which prevails over this document.
§ 1 Who we are
The website www.biobuilds.com is operated by BIOBUILDS S.R.L., with registered office at Str. 66, no. 16, Tăuții-Măgherăuș, 437345, Maramureș County, Romania, registered with the Trade Register Office under No. J24/300/2012, unique registration code RO30040678, legally represented by Muste Alin, Administrator. § 2 What you find on the website
On the website we present the BioBuilds prefabricated modules - the Sanctuary, Serenity, Wanderlust and Nest models - together with information about the Passivhaus certified system, the materials used, the manufacturing and delivery process, our technical principles and completed projects. Through the configurator you can explore customisation options and obtain an indicative price estimate.
The images, descriptions, prices, delivery terms and configurator results displayed on the website are informative and do not constitute a firm offer within the meaning of Art. 1188 of the Civil Code. The firm offer, with the specifications, prices and terms applicable to your specific situation, is sent to you individually after contacting our team.
The construction system is Passivhaus certified. The certification refers to the construction system, not to the completed unit at the site. The actual energy performance of the final unit depends on the foundation, airtightness, utility connections and manner of use.
§ 3 How the interaction with BioBuilds takes place
The path from initial interest to the delivered module follows these steps:

| 2 | Contact us through the form, by e-mail or by telephone for a personalised discussion. At this point, you tell us whether you are acting as a natural person for private purposes or as a company for professional purposes, plus the delivery country. |
| 3 | You receive a personalised offer with the specifications, prices, schedule and terms applicable to your situation. |
| 4 | We agree together on the module customisations and prepare the individual contract. |
| 5 | We sign the individual sale-purchase contract and its annexes. From this moment, the commercial relationship is governed by the contract, not by this document. |
| 6 | Production, DAP delivery to the agreed destination, technical support and warranty management - in accordance with the individual contract. |
When you contact us, we ask you to indicate whether you are acting as a natural person for private purposes or on behalf of a company or for professional purposes. If you act for professional purposes, you do not have the status of consumer within the meaning of GEO 34/2014. Consumer-specific rights - including the statutory 14-day right of withdrawal, the legal guarantee of conformity under GEO 140/2021 and the reversal of the burden of proof for the first 12 months - apply only if expressly provided by law or by the individual contract.
§ 4 Prices and availability
The prices displayed on the website are indicative and expressed in EUR. VAT and final costs are calculated depending on the delivery country and the customer's status. For consumers, the final gross price, including VAT and all applicable costs, is communicated to you in the personalised offer before signing the contract. For companies, prices may be displayed net plus VAT, in accordance with the applicable tax regulations.
The price displayed for each model covers, indicatively, the module manufactured in the standard configuration, delivered DAP (Delivered at Place, Incoterms 2020) to the agreed destination, with all-risks cargo insurance included during transport. The costs for customisations depend on the final specifications and are communicated separately in the personalised offer. Unloading, crane, positioning on the foundation, utility connections, local permits, site works, land and foundation are not included in the module price and are organised by the Buyer through service providers chosen by the Buyer.
The availability of modules depends on our current production plan. Deadlines are confirmed in the offer and guaranteed through the individual contract. We reserve the right to update the prices, availability and specifications displayed on the website, without this affecting orders for which a contract has already been signed.
§ 5 Pre-contractual information for consumers
Right of withdrawal and exclusion under GEO 34/2014
For consumers who conclude a distance or off-premises contract with BioBuilds, the 14-day right of withdrawal is regulated by Government Emergency Ordinance No. 34/2014 on consumer rights (transposition of Directive 2011/83/EU).
If the module is manufactured according to the consumer's specifications or is clearly personalised, the statutory exception to the 14-day right of withdrawal may apply, in accordance with Art. 16 letter c) of GEO 34/2014. The application of this exception is confirmed in the individual contract, based on the specific customisations documented and accepted by the client in the Design Confirmation annex. Complete information on the right of withdrawal and the model form are sent to you as a separate document, for separate signature, when signing the contract.
Warranty for consumers
For each BioBuilds module you benefit from:

The full details regarding duration, coverage, complaint procedure and remedy periods are included in the individual contract and in the warranty certificate attached to it.
§ 6 Product safety
BIOBUILDS S.R.L. is the manufacturer of the modules and, to the extent applicable, the economic operator responsible in the European Union in accordance with Art. 4 of Regulation (EU) 2023/988 on general product safety. We ensure the traceability of each module by serial number, batch, model and production date. For safety questions, warnings or incidents: compliance@biobuilds.com.
§ 7 Use of the website
We invite you to use the website for information purposes and to explore the offer. Please do not use the website for unlawful purposes, do not attempt unauthorised access to systems, do not use automated tools to extract content without our consent, and respect the intellectual property rights over the published content.
We may suspend access to the website or to certain functionalities for maintenance, updates or security reasons, without prior notice. We make reasonable efforts to maintain the availability of the website, but we do not guarantee uninterrupted availability.
§ 8 Intellectual property
All elements published on www.biobuilds.com - texts, images, photographs, videos, plans, sketches, renderings, three-dimensional models, logos, trademarks, product names (Sanctuary, Serenity, Wanderlust, Nest, Modular, BIOBUILDS), design elements of the construction system - are the intellectual property of BIOBUILDS S.R.L. or its licensors.
The use, reproduction, distribution, reverse engineering or commercialisation of these elements for commercial purposes requires our prior written consent. Private use for information purposes is permitted under the conditions of the law. Infringements may give rise to civil and, where applicable, criminal liability.
§ 9 Personal data protection
The processing of your personal data through the website, forms and configurator is described in the Privacy Policy, available at www.biobuilds.com/ro/privacy-policy. The Privacy Policy is informative and must be read together with this document, without use of the website being equivalent to general consent for data processing. The Cookie Policy is accessible at www.biobuilds.com/ro/cookie-policy and from the "Cookie settings" link permanently available in the footer.
§ 10 Marketing communications
If you subscribe to the newsletter or give us your consent for marketing communications, we may send you information about new models, offers, events and relevant content. For all marketing communications by e-mail, we use double opt-in confirmation, in accordance with Law No. 365/2002. You may unsubscribe at any time through the link in the e-mail or by request to privacy@biobuilds.com, without affecting the lawfulness of prior communications.
§ 11 Links to external websites
The website may contain links to external websites - partners, certifications, social networks, information materials. These links are provided for information purposes. Responsibility for the content and privacy policies of external websites lies with their operators.
§ 12 Limitation of liability for use of the website
The content of the website is updated periodically. We make reasonable efforts to keep the information accurate and complete, but we do not guarantee that all information is completely free of errors at all times. The technical specifications, prices and terms applicable to each order become binding only through the signed personalised offer and the individual contract.
The limitation of liability in this article refers exclusively to the use of the website. Your rights as a consumer, in particular those arising from GEO 34/2014, GEO 140/2021 and Law No. 240/2004, remain fully unaffected by this document. The liability of BIOBUILDS S.R.L. for damage caused by injury to life, body or health, for intent and gross negligence, and under Law No. 240/2004 on producer liability for damage caused by defective products, cannot be restricted by this document.
§ 13 Resolution of complaints and disputes
If you have a complaint related to the website or to the pre-contractual interaction with BioBuilds, please contact us at reclamatii@biobuilds.com. We confirm receipt of the complaint within a maximum of 5 working days and provide a substantive response within a reasonable period, generally within a maximum of 30 calendar days, depending on the complexity of the situation.
BIOBUILDS S.R.L. does not voluntarily participate in alternative dispute resolution procedures through an ADR entity, except where applicable law requires otherwise. This position does not affect your right to contact the National Authority for Consumer Protection (ANPC, www.anpc.ro) and the competent courts.
§ 14 Applicable law and jurisdiction for use of the website
The use of the website www.biobuilds.com and the pre-contractual relationships with BioBuilds are governed by Romanian law. For disputes with Romanian consumers arising from use of the website, the court at the consumer's domicile has jurisdiction. For consumer clients from other Member States of the European Union, the protection rules provided by Regulation (EC) 593/2008 (Rome I), Art. 6, also apply.
For individual sale contracts, the applicable law, competent court and dispute resolution mechanisms are those expressly indicated in the individual contract signed by the parties.
§ 15 Amendment of the terms
We may periodically update these terms to reflect legislative, operational or offer-related changes. The version in force is permanently available at www.biobuilds.com/ro/terms-and-conditions, with the date of the last update visible. Changes enter into force 30 days after publication. Changes applicable to individual contracts already signed are governed exclusively by the contract.
